Mr. Ajay Kumar, AC to GP-4 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 26-07-2021 Heard learned counsel for the petitioner and learned A.C. to G.P.-4 for the State.
The present writ application has been preferred seeking a direction to the respondents to recover the minor son of the petitioner who has been allegedly kidnapped by one Bhola Turha for ransom. Further prayer is to direct the respondents to complete the investigation and submit charge-sheet before the concerned court where the matter is pending.
Pursuant to the earlier orders passed by this Court the Superintendent of Police, Buxar (Respondent No. 5) seems to have
Patna High Court CR. WJC No.384 of 2020(7) dt.26-07-2021 2/2 supervised the investigation. He has filed his affidavit on 13.07.2021. The Superintendent of Police says that he has issued report-3 and the same has been sent to D.I.G., Sahabad, Dehri-on-Sone for concurrence.
Learned counsel for the State submits from the report - 3 (annexure 'B' to the counter affidavit of respondent no. 5) it would appear that SDPO and Inspector of Police have been given certain directions and they have been directed to submit further progress report.
In the aforesaid view of the matter, this writ application is being disposed of with a direction to the respondents to complete the investigation of this case within a maximum period of three months from today and submit it's report in terms of the provisions of the Cr.P.C. before the learned court where the matter is pending within one month thereafter. It will be open for the informant to make proper application before the learned court where the report is submited and if such an application is filed then same will be considered in accordance with law.
