JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Rajapakar P.S. Case No.122 of 2020 for the offence under Sections 413 and 414 of the Indian Penal Code. The allegation against the petitioner is that he was involved in theft of Sumo car.

Learned counsel appearing on behalf of the petitioner would submit that in fact, the petitioner has been falsely implicated in this case as he has no concern with the theft Sumo car. He further submits that the petitioner was passing through the place where Sumo car was standing and only on suspicion, he has been made accused. Petitioner is in custody since 02.06.2020.
