2. Permission is accorded.
3. Accordingly, the bail petition of Petitioner No. 1 is dismissed as withdrawn.
4. Heard learned counsel for Petitioner No. 2 and learned APP for the State.
5. Petitioner No. 2 seeks regular bail in connection with Desari P.S. Case No. 192 of 2023 for the offences registered under Section 392 of the Indian Penal Code.
6. It is alleged in the prosecution case that while
Patna High Court CR. MISC. No.33690 of 2024(5) dt.18-10-2024 2/3 informant and her mother were coming on a tempo, on the way two motorcycle borne miscreants came and snatched her golden chain and fled away. It is alleged that on the back of motorcycle there was written the word 'Ahiran'.
7. Learned counsel for Petitioner No. 2 submits that he is innocent and has falsely been implicated in this case on the basis of confessional statement of co-accused persons. Petitioner No. 2 is not named in the F.I.R. No incriminating article has been recovered from his possession. Except confessional statement of co-accused there is no material against Petitioner No. 2. Charge-sheet has already been submitted against Petitioner No. 2. He undertakes to co-operate in the trial. Petitioner No. 2 has two criminal antecedents in which he is on bail. He is in judicial custody since 24.02.2024.
8. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
9. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let petitioner no. 2, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Desari
