2. The petitioner seeks bail in a case registered for offence under Sections 363, 366(A)/34 of the Indian Penal Code.
3. Allegation against this petitioner and other coaccused persons is that they kidnapped the minor daughter of the informant for the purpose of marriage and when the informant inquired about the same, she was abused by the accused persons.
4. Learned counsel for the petitioner submits that specific accusation of kidnapping the minor daughter of the informant is against co-accused Santu Chauhan @ Raju Kumar @ Sintu Kumar, who has already been granted bail by a
Patna High Court CR. MISC. No.35566 of 2024(2) dt.19-07-2024 2/2 coordinate Bench of this Court, vide order dated 21.06.2024 passed in Cr.Misc. No. 24544 of 2024. The victim, in her statement recorded under Section 164 Cr.P.C., has not alleged any wrong against this petitioner and has only stated that she was forcibly kidnapped by the accused persons and thereafter, in Kolkata, she got married with co-accused Santu Chauhan and thereafter, she with her consent established physical relation with co-accused Santu Chauhan. Petitioner has got clean antecedent and is in custody since 28.02.2024.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Belaganj P.S.
