The petitioner has preferred this application for grant of regular bail in a case registered under sections 395 and 397 of the Indian Penal Code and section 27 of the Arms Act. As per the report received from the learned court below, cognizance has been taken under sections 395, 396 and 397 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, 8-10 persons armed with firearm surrounded the informant and snatched the bag containing Rs.5.35 lacs as also some documents. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in course of investigation in the
Patna High Court CR. MISC. No.41011 of 2021(4) dt.11-02-2022 2/2 confessional statement of co-accused Manish Kumar made before police. The said Manish Kumar has himself been enlarged on bail vide order dated 2.5.2019 (Annexure 3) passed in Cr. Misc. no.18315 of 2019. The petitioner is in custody since 19.4.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, grant of bail to co-accused Manish Kumar on whose confessional statement the name of the petitioner transpired and the petitioner having remained in custody for more than 9 months, the Court directs the petitioner to be enlarged on bail in connection with Patepur P.S. Case no.178 of 2018 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge XI-cumAdditional Chief Judicial Magistrate X, Vaishali at Hajipur.
