JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-02-2023 Heard the learned counsel for the petitioner and the learned A.P.P. for the State. The petitioner seeks regular bail in connection with Phulwaria P.S. Case No. 32 of 2022, registered for the offences punishable under Sections 394 and 397 of the Indian Penal Code. The allegation levelled by the informant is that when he was returning back to his home after giving exam at Patna on 28.02.2022, on the way at about 11:15 P.M., he was intercepted by four unknown miscreants, whereupon they had on pistol point snatched a sum of Rs. 700/- and one mobile phone as also assaulted the informant.

No.31029 of 2022(4) dt.06-02-2023 2/2 The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case and he is languishing in custody since 17.03.2022. It is further submitted by the learned counsel for the petitioner that the petitioner is an accused in eight other cases but he is on bail in the said cases, however, considering the fact that the stolen mobile phone has been recovered from the possession of the petitioner, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to renew the prayer for bail after expiry of one year from today.

Accordingly, the present petition stands disposed off as not pressed, however, with liberty to the petitioner to renew his prayer for bail immediately upon completion of one year from today.
