2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) and 36 of the Bihar Prohibition & Excise Amendment Act.
3. Prosecution case is that total 13 litres mahua liquor has been recovered which was allegedly carried in bag by the petitioner and seeking the police, petitioner managed to flee away.
4. Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case only on suspicion. Petitioner has got one criminal antecedent of a similar nature in which he is on bail.
5. Considering the facts of the case, this pre-arrest bail
Patna High Court CR. MISC. No.33995 of 2024(2) dt.23-05-2024 2/2 petition is allowed. In the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Special Judge Excise, Patna City in connection with Khushurpur P.S. Case No. 06 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
