In this case, the petitioner is seeking anticipatory bail in connection with Shambhuganj P.S. Case No. 55 of 2018 (G.R. No. 1004 of 2018) registered for the offence under Sections 25-1-b)a, 26 and 35 of the Arms Act. As per the F.I.R. some scuffle was going on in the Mela on account of an accident. The informant along with others went there and saw that people were slapping the persons and on search a country made pistol as well as two live cartridges were recovered from the said persons, whereafter the said persons were handed over to the Police. The arrested persons have disclosed that the petitioner has supplied the pistol and live cartridges to them.

No.28992 of 2019(2) dt.02-05-2019 2/2 Looking to the entire facts and circumstances of the case, let the above-named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the S.D..J.M., Banka, in connection with Shambhuganj P.S. Case no. 55 of 2018 (G.R. No. 1004 of 2018), subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
