JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2018 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners are apprehending their arrest in a case registered under Sections 386, 420, 387, 120B, 406, 482 of the Indian Penal Code.

The prosecution case, in short, is that the accused persons on the point of pistol got executed a sale deed in favour of petitioner No.2.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the

Patna High Court Cr.Misc. No.52823 of 2018(2) dt.20-09-2018 2/2 present case. As per the allegation, the informant was forcibly made to executed a sale deed in favour of the petitioner No.2. Till date no cancellation of registration of the sale deed in question has been filed on behalf of the informant. The matter relates to civil dispute.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Manjhaul, District Begusarai in connection with Cheriabariarpur P.S. case No.98 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
