1. Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 504 and 506/34 of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioner submits that Manoj Kumar Chaudhary had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 33728 of 2024 and the same was allowed by an order dated 01.10.2024. It is further submitted that while granting the anticipatory bail to Manoj Kumar Chaudhary, the Court in detail has considered his case on merits. It is next submitted that the
Patna High Court CR. MISC. No.34548 of 2024(2) dt.01-10-2024 2/2 case of the petitioner is on a better footing than Manoj Kumar Chaudhary as the petitioner is purchaser of the land from Manoj.
4. Learned A.P.P. for the State and the learned counsel appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Motihari Mufassil P.S. Case No. 873 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
