The petitioners have challenged the order dated 06.05.2014 passed by the learned Judicial Magistrate 1st Class, Jamui in Jhajha P.S. Case No. 16/2014, whereby cognizance has been taken against the petitioners under Sections 147, 148, 149, 307 of the Indian Penal Code read with Section 27 of the Arms Act.

A report was called for from the court below, which has been received wherein it has been mentioned that after framing of charge the case is pending for evidence. P.W. 1, namely, Rajendra Ram has already been examined. He turned

Patna High Court Cr.Misc. No.3142 of 2015 (3) dt.25-07-2018 2/2 hostile. Summons has been issued against the witnesses named in the charge-sheet.

Therefore, this Court is not inclined to interfere with the impugned order dated 06.05.2014. Accordingly, this Criminal Miscellaneous is dismissed.

The court below will proceed with the trial in accordance with law.
