2. The petitioner apprehends his arrest for the offences alleged under Sections 126, 115(2), 109, 89, 352, 351(2)/3 (5) of the BNS, registered in connection with Fatuha P.S.Case No. 531 of 2024.

The learned counsel for the petitioner has submitted that because the informant forcibly ousted the parents of the petitioner from their house, the petitioner lodged a case against the informant and in retaliation thereof, the present case has been lodged. Having left with no option, the petitioner is residing in a 3BHK rented flat with his parents in Mewalal

Patna High Court CR. MISC. No.32863 of 2025(4) dt.09-10-2025 2/2 Complex, Kumhrar and the informant is residing in the house of the petitioner. Further submission of the learned counsel is that the petitioner has also filed a divorce case against the informant. Except the present case, the informant has filed a second complaint petition with similar allegations.

4. On the other hand, the learned counsel for the informant has opposed the prayer for anticipatory bail by submitting that the petitioner and his family members tortured the victim variously.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate Patna city in connection with Fatuha P.S.Case No. 531 of 2024, subject to the conditions as laid down under Section 438(2) Cr. P.C/482(2) of the BNSS, 2023.
