This application for anticipatory bail, arises out of Pupri Police Station Case No. 173 of 2018, disclosing offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 354, 447, 504 and 506 of the Indian Penal Code. Petitioner no. 1 is the mother of petitioner no. 2. There is allegation against persons named in the First Information Report, belonging to the same family of assault on the informant and her family members.

Learned Counsel appearing on behalf of the petitioners has submitted that there is no specific allegation of any overt act against these petitioners and other co-accused

Patna High Court CR. MISC. No.28355 of 2019(2) dt.30-04-2019 2/2 persons namely, Chandan Kumar, Kundan Kumar and Sonu Kumar, who have been allowed anticipatory bail by this Court, by order, dated 20.11.2018, passed in Criminal Misc. No. 54880 of 2018.

Considering the above submission, this application is allowed.

Let the petitioners, above-named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate in connection with Pupri Police Station Case No. 173 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
