The petitioner apprehends his arrest in connection with Begusarai Muffasil P.S. Case no. 457 of 2017, registered under Sections 147, 148, 149, 447, 307 and 506 of the Indian Penal Code and section 27 of the Arms Act.
The accusation is that 10 persons named in the F.I.R. including the petitioner, variously armed with weapons came at the door of the informant and starting firing, but firing was not hit to the informant, rather, the firing hit to the chhaja of the house.
Learned counsel for the petitioner submits that, in fact, due to dispute the informant lodged this case with false allegation of firing against petitioner Murari Kumar and Nitesh
Patna High Court Cr.Misc. No.54351 of 2018(2) dt.28-09-2018 2/2 Kumar, but the same was not hit to the informant rather the same was hit to the Chhaja and wall of the informant. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Begusarai (Muffasil) P.S. Case No. 457 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
