APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 15-05-2019 The present petition has been filed for modification of the order dated 28.01.2019 passed in Cr. Misc. No. 481 of 2019.

2. It is submitted that the petitioner was granted provisional anticipatory bail by order dated 28.01.2019 but one of the conditions thereof requiring surrender and furnishing of bail bond within a period of four weeks could not be complied with owing to communication gap between the counsel and the petitioner. It has further been prayed for extension of time for a further period of four weeks for furnishing of bail bond.

3. This Court takes note that bail bond was required to be furnished by 28.02.2019. The order of provisional anticipatory bail was confirmed much later on 25.03.2019 by a coordinate Bench of this Court after hearing the petitioner who did not

Patna High Court CR. MISC. No.28958 of 2019(2) dt.15-05-2019 2/2 however point out that the petitioner had not surrendered till then.

4. In the above circumstances, this Court is not inclined to interfere in the matter. The modification petition stands dismissed.
