The petitioner apprehends his arrest in connection with Bela P.S. Case no. 21 of 2018, registered under Sections 406, 420, 467, 468 & 471/34 of the Indian Penal Code. The accusation is that Shiv Nath Chaudhary father of the petitioner, in presence of the petitioner, talked to sell his factory i.e. Shiridih Food Private Limited established in area of 1400 Sq. feet in Muzaffarpur saying that the factory has loan of Rs. 30 Lakhs and accordingly, father of the petitioner executed the deed of agreement to transfer the factory along with land and machines and the informant being the director of

Patna High Court Cr.Misc. No.54334 of 2018(2) dt.28-09-2018 2/2 Satyanarayan Pood Processing Pvt. Limited paid Rs. 25 Lakhs, but the father of the petitioner as well as petitioner are not ready to transfer the said factory.

Learned counsel for the petitioner submits that, in fact, agreement is between father of the petitioner and informant, but the petitioner has falsely been implicated in this case. Moreover, father of the petitioner is still ready to transfer the factory on payment of remaining amount of Rs. 30 Lakhs. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge-XII-cumACJM, Muzaffarpur in connection with Bela P.S. Case No. 21 of 2018, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
