2. The petitioner has prayed for regular bail in connection with a case registered for the offences punishable under Sections 305 and 331(4) of the BNS.

3. The prosecution case, in brief, is that unknown miscreants committed theft in the shop of the informant and allegedly stole 10 kg of silver and 10 grams of gold from the said shop.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the F.I.R. was instituted against unknown miscreants and, during the course of investigation, one

The name of the present petitioner surfaced only in the confessional statement of the co-accused. It is further submitted that, save and except the confessional statement of the co-accused, there is no material against the petitioner. Learned counsel further submits that a similarly situated co-accused has already been granted bail by a co-ordinate Bench of this Court vide order dated 31.10.2025 passed in Cr. Misc. No. 75366 of 2025. It has also been submitted that the petitioner is in judicial custody since 13.06.2025. However, the petitioner has criminal antecedents in 13 cases.

5. Learned APP appearing on behalf of the State has opposed the prayer for regular bail.

6. Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail.

7. Accordingly, the above-named petitioner is directed to be released on bail in connection with Banke Bazar P.S. Case No. 27 of 2025 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class,

Patna High Court CR. MISC. No.31015 of 2026(2) dt.11-05-2026 3/3 Sherghati, Gaya, subject to the following conditions: (i) The petitioner shall co-operate with the trial and shall remain physically present on each and every date fixed by the Court;

(ii) One of the bailors shall be a near relative of the petitioner; and (iii) The petitioner shall mark his weekly attendance before the Officer-in-Charge, Imamganj Police Station, till conclusion of the trial.
