Learned counsel for the petitioner has stated that during the pendency of the present writ petition, the petitioner as well as the respondents have arrived at the settlement agreement and under the terms of the said settlement, the petitioner has paid an amount of Rs. 55,00,000/- to the respondent No. 5 and, therefore, learned counsel has prayed this
Patna High Court CWJC No.7419 of 2023(8) dt.11-01-2024 2/2 hon'ble Court to set aside the impugned order dated 06.04.2023 passed by Respondent No. 4 in Reference No. 09/2021 and the matter may be disposed of.
2. Learned counsel appearing on behalf of the Respondent No. 5 has not disputed the same and has stated that the matter may be disposed of as the Respondent No. 5 has received an amount of Rs. 55,00,000/- as per the terms of settlement agreement. The copy of the settlement agreement dated 29.11.2023 filed along with the supplementary affidavit filed by the petitioner.
3. Having regard to the above made submissions, the impugned order dated 06.04.2023 is set aside.
