The matter has been taken up through video conferencing.

Petitioner seeks regular bail in a case registered for the offence punishable under Section 307, 120(B), 34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, this petitioner along with other co-accused made indiscriminate firing as a result of which son of the informant sustained fire arm injuries. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.40630 of 2021(3) dt.01-02-2022 2/2 case. There is general and omnibus allegation against this petitioner and no specific overt act has been alleged against him. Petitioner is in custody since 09.08.2019 and investigation in this case is complete.

Learned counsel appearing for the State and the informant opposed the prayer for bail and submitted that petitioner is named in the FIR and there is specific allegation of firing against this petitioner along with other co-accused. It is further submitted that petitioner has got criminal antecedent and he is accused in four other criminal cases, as stated in paragraph 3 of the petition.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
