2. The petitioner in the present case is seeking prearrest bail in connection with Sakurabad P.S. Case No. 187 of 2023 registered for the offences punishable under Section 379 of the Indian Penal Code. He has got one criminal antecedent in which he is said to be on bail.

3. As per the prosecution story, the accused Ravindra Singh along with 5-6 unknown persons have stolen the submersible motor along with pipe of informant. When the informant identified them in torch light, the accused Ravindra Singh threatened him to kill and on next day accused visited his house and once again threatened him to face dire consequences.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel submits that the petitioner is uncle of the informant and both the parties are having some land dispute and family dispute and for that reason the petitioner has been falsely implicated.

5. Learned APP for the State and learned counsel for the informant have opposed the prayer for anticipatory bail of the petitioner.

Having regard to the submissions that the petitioner is uncle of the informant and both the parties are having some land dispute and family dispute and for that reason it is submitted that the petitioner has falsely been implicated, he has otherwise one criminal antecedent with respect to the local body election in which he is on bail, this Court directs that in case of his arrest or surrender within a period of four weeks from today, the petitioner above named be released on bail in connection with Sakurabad P.S. Case No. 187 of 2023 on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Jehanabad subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

7. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.

8. This application stands allowed.
