JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-03-2019 Considering the submission made by learned counsel for the opposite parties that payments have been made, time till 11.03.2019 was granted to the petitioner to verify the fact whether payments were made or not.

Till date there is no affidavit controverting the aforesaid fact.

In view of the above, the Court has no other way but

Patna High Court MJC No.2017 of 2017(4) dt.13-03-2019 2/2 to accept the averments made by the opposite parties. Considering the fact that payments have been made, the Court is not inclined to proceed further in the matter. The present proceeding is accordingly dropped and the application stands disposed of.
