The petitioner has renewed his prayer for bail in connection with Sessions Trial No. 359 of 2018 arising out of Karakat P.S. Case No. 256 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 120B, 504 and 506 of the Indian Penal Code. His prayer for bail was earlier rejected by this Court vide order dated 22.02.2019. It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 16.07.2018. The charges were framed in the year 2018 itself. After the framing of charge, four witnesses were examined in the year 2019 and, since then, there is no progress in the trial. He contended that a co-accused Upendra Singh having identical allegation as against

Patna High Court CR. MISC. No.41448 of 2021(2) dt.20-04-2022 2/2 the petitioner has already been granted bail by a Bench of this Court vide order dated 09.04.2019 passed in Cr. Misc. No. 51927 of 2018.

Learned counsel for the State opposed the prayer for bail. However, he does not dispute the submission that another co-accused whose case is identically situated to that of the petitioner has already been granted bail.

Considering the submissions made above and the period of custody undergone by the petitioner as an under trial prisoner, I am inclined to grant bail. He is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-16 Rohtas at Sasaram in connection with Sessions Trial No. 359 of 2018 arising out of Karakat P.S. Case No. 256 of 2017.
