2. The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 420 of the Indian Penal Code.

3. As per the prosecution case, the petitioner entered into an agreement with the complainant to sale a piece of land, which was not owned and possessed by him. The land, proposed to be sold by petitioner, was actually owned by his maternal grand father and the same was already sold to someone else, but concealing this fact, the petitioner received an amount of Rs. 8 lakhs from complainant and in this way, he deceived the complainant.

4. Learned counsel for the petitioner submits that

The dispute involved in the complaint petition is purely of civil nature. However, without admitting the allegation made in the complaint petition, the petitioner is ready to deposit the alleged amount of Rs. 8,00,000/- (Rupees eight lacks) in easy installments in the Nazarat of concerned Civil Court.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Purnea in connection with Complaint Case No. 569 of 2024, subject to condition as laid down under Section 438(2) of the Cr.P.C. / 482 of the B.N.S.S. with further following conditions: "(A) At the time of furnishing bail-bond, the petitioner shall deposit Rs. 5,00,000/- (Five lacks) in the Nazarat of concerned Civil Court and receipt of the same shall be furnished along with bailbond. (B) Rest amount i.e. Rs. 3,00,000/- (Three Lacks) shall be deposited in the Nazarat of concerned Civil Court in two installments of Rs. 1,50,000/- (one lack fifty thousand) each within a period of six months from the date of furnishing

(C) The aforesaid payment shall be subject to final outcome of the case.

(D) If petitioner fails to comply the direction of this Court, the learned Court below would be at liberty to cancel the bail-bond of the petitioner."

6. This order has been passed, without going into the merit of the case, only for the purpose of considering the prayer for anticipatory bail of petitioner.
