The petitioner seeks pre-arrest bail in connection with Ballia P.S. Case No.349 of 2018 registered for the offences punishable under Sections 302 and 201 read with 34 of the Indian Penal Code.

Considering that the petitioner is one of the named accused in the first information report and there is allegation that he actively participated in commission of the murder of his son-in-law as also the post mortem examination report goes to suggest that the victim had sustained multiple bruises with abrasion and the doctor conducting the autopsy opined that death was due to asphyxia as a result of injury caused by throttling, I am not inclined to grant pre-arrest bail to the
