JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-03-2021 The petitioner superannuated on 31st January, 2012.We are in 2021. The petitioner claims that he has been granted 3rd ACP with effect from 1.1.2009 but the respondents have not considered the case of the petitioner for pay revision in terms of grant of ACP. It is admitted by the petitioner that after 7th pay revision the petitioner has been granted the benefit of pension in terms of 7th PRC w.e.f. 1.4.2017 but the monetary benefit to which he is entitled to right from the date of grant of ACP i.e. 1.1.2009 has not reached the petitioner.

Patna High Court CWJC No.8015 of 2020(2) dt.09-03-2021 2/2 Considering the fact that the petitioner has retired in 2012, instead of keeping the matter pending, the writ petition is disposed of with a direction to the respondents to appropriately decide the claim of the petitioner keeping in view the fact that they themselves have granted 3rd MACP to the petitioner on 20.6.2019 with effect from 1.1.2009, the consequential monetary benefit must be extended to the petitioner within a maximum period of three months from the date of filing a representation along with a copy of this order. With the aforesaid, the writ petition stands disposed of.
