Case No. 15 of 2009 and Siswan P.S. Case No. 16 of 2009 have been filed by both sides. Siswan P.S. Case No. 15 of 2009 has been filed by the present petitioner whereas Siswan P.S. Case No. 16 of 2009 has been filed by other side and separate trial is going on and both the trial are at the stage of prosecution evidence. Hence, both the trials are required to be conducted by the same Court so as to avoid any conflicting judgment.

2. Hence, learned counsel for the petitioner is seeking permission to withdraw the present petition with liberty to file appropriate application before learned trial court for trial of both the cases arising out of Siswan P.S. Case No. 15 of 2009 and

Patna High Court CR. REV. No.559 of 2019(8) dt.21-03-2025 2/2 Siswan P.S. Case No. 16 of 2009 by the same Court.

3. Permission is accorded.
