2. The petitioners are apprehending arrest in connection with Govindganj P.S. Case No. 256 of 2024, dated 22.06.2024, lodged under Section 147, 148, 341, 323, 324, 354, 307, 379, 504 and 506 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against four named accused persons, including the present petitioners, alleging that all the accused went to the informant's house and assaulted him. It has further been alleged that they also tried to outrage the modesty of the informant's daughter-in-law and

Patna High Court CR. MISC. No.30700 of 2025(2) dt.15-05-2025 2/3 looted jewellery worth 2,00,000/- along with 20,000/- in ₹ ₹ cash.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel further submits that against petitioner No. 3, there is absolutely no allegation, save and except that he is alleged to be a member of the mob, and against petitioners Nos. 1 and 2, the allegation is that they attempted to outrage the modesty of the informant's daughter-in-law. Counsel further submits that there is a case and a counter-case, the wife of petitioner No. 1 has lodged a case against the informant's side, which has been registered as Govindganj P.S. Case No. 258 of 2024. Counsel also submits that the petitioners have clean criminal antecedents.

5. Learned APP for the State opposes the prayer for bail of the petitioners.

As such, in the present facts and circumstances of this case, let the petitioner No. 1, namely, Shambhu Yadav, whose wife has lodged a case against the informant's side and the petitioner No.3, namely, Upendra Kumar be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing

Patna High Court CR. MISC. No.30700 of 2025(2) dt.15-05-2025 3/3 bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of C.J.M., East Champaran, in connection with Govindganj P.S. Case No. 256 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.

7. So far as the bail application of the petitioner No. 2, namely, Prabhu Yadav is concerned, his bail application is hereby rejected.
