Earlier, the bail petition of petitioner was rejected, vide order dated 05.06.2020 passed in Cr.Misc. No. 2485 of 2020 (Annexure - 1) with following observation: "If the trial is not concluded within one year, the petitioner may renew his prayer for bail." The trial court report (flag 'P') reveals that cognizance has already been taken on 07.09.2020 against the accused persons and now, the case is pending for appearance of co-accused Durgawati Devi.

It is submitted on behalf of petitioner that trial is not progressing smoothly and petitioner is languishing in jail since 24.06.2019.

Taking into consideration the nature of accusation and

Patna High Court CR. MISC. No.41550 of 2021(4) dt.04-03-2022 2/2 stage of the trial, the bail petition of petitioner is rejected. However, since the petitioner is in custody since 24.06.2019, the learned trial court is directed to conclude the trial as early as possible.
