Petitioner is an owner of a truck which was seized by the police on account of over loading of stone chips from Depot of other co-accused and for that, instant prosecution has been launched. Admittedly, petitioner was not present at the spot rather loading was at the behest of driver and that being so, petitioner, Anand Bijay Kumar is directed to be released on bail, in the event of his arrest /surrender, before the learned lower court within fortnight on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Ghagha) PS Case No. 432/2018 in terms of condition as laid down under Section 438(2) Cr.P.C.
