Earlier prayer for bail of the petitioners was refused by this Court vide order dated 23.11.2020, passed in Cr.Misc.No. 25684/2020.
Perused the trial court's report dated 19.8.2021. Petitioners are in custody since 28.2.2020.
Considering the nature of allegation, period of incarceration of the petitioners and progress of the trial, prayer for bail of all the three petitioners is allowed. Let the petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial
Patna High Court CR. MISC. No.40812 of 2021(3) dt.06-10-2021 2/2 Magistrate X, Gaya in Neemchak Bathani Police Station Case No. 15 of 2020 on the following conditions:-
(1) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below.
(2) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
