The petitioners apprehend their arrest in connection with Bikram P.S. Case No. 153 of 2017, registered under Section 341, 323 & 325/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of the Addl. Chief Judicial Magistrate-V, Danapur.

The accusation is that in the evening of 09.06.2017, on hearing the quarrel in between Bijendra Yadav and Babunath. The informant Bindu Devi came out from her house then saw that Ranjeet Yadav was being assaulted by Bijendra Yadav. At that time, Babunath handed over pistol to Rana Rai (Petitioner No.1), then he opened fire at Ranjeet

Patna High Court Cr.Misc. No.53437 of 2018(2) dt.11-12-2018 2/2 Yadav, but the same was hit to Bijendra Yadav at his back. The petitioner No.2 Nirala Rai also caused injury at the head of Ranjeet Yadav through Farsa.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of pre-arrest bail stands rejected. The petitioners are directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
