The petitioner seeks bail in Chanpatiya P.S. Case No. 93 of 2017, registered for the offence punishable under Sections 147, 149, 341, 323, 308 and 354 of the Indian Penal Code and section 12 of the POCSO Act.
As per the prosecution case, this petitioner along with other FIR named accused persons misbehaved with the cousin sister of informant and when the informant protested the accused persons assaulted him by fist and slaps. It is submitted on behalf of petitioner that there is general and omnibus allegation and no specific overt act has been alleged against this petitioner. As per the FIR, the main accusation is against co-accused Amit Kumar Singh and Vishal
Patna High Court CR. MISC. No.41220 of 2021(4) dt.21-02-2022 2/2 Kumar. Co-accused Amit Kumar Singh has already been granted anticipatory bail by this Court vide order dated 27.08.2019 passed in Cr. Misc. No. 53547 of 2019. Petitioner is in custody since 05.04.2021.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO-cum-Additional Sessions Judge VI, Bettiah, West Champaran in connection with Chanpatiya P.S. Case No. 93 of 2017.
