The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 307, 379, 354, 448, 504 and 302 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner variously armed came and assaulted the informant's uncle on his head by iron rod, due to which the informant's uncle succumbed to the injuries. The accused persons also assaulted other family members of the informant by means of lathi, danda and snatched gold chain.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.11.2018 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.29577 of 2019(4) dt.27-08-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made. No specific overt act is alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned IInd Additional Sessions Judge, Gopalganj in connection with Sessions Trial No.129 of 2019 arising out of Mirganj P.S. case No.329 of 2018.
