JUSTICE ANIL KUMAR SINHA ORAL ORDER 27-11-2020 Heard Mr. Nawal Kishore Singh, learned counsel for the petitioner and Mrs. Madhuri Lata, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Garkha P.S. Case No. 496 of 2018 registered for the offence under Section 341 / 323 / 324 / 307 / 384 / 504 / 34 of the I.P.C. The allegation as per the First Information Report is that the petitioner assaulted the informant by means of butt of the country made pistol and also demanded a sum of Rs. 5,000/- as ransom.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to land dispute. Learned counsel further submits that case diary was

No.30103 of 2020(2) dt.27-11-2020 2/2 called for before the court below and from perusal of the impugned order it would be evident that the learned Sessions Judge has not discussed the nature of injury caused to the victim. Learned counsel further submits that petitioner is in custody since 23.05.2020.

Having heard learned counsel for the parties and taking into consideration the materials available on record and the fact that petitioner is in custody since 23.05.2020, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIVth, Saran at Chapra in connection with Garkha P.S. Case No. 496 of 2018. It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
