Petitioner has prayed for the following relief(s):-
Patna High Court CWJC No.8989 of 2022 dt.29-07-2022 2/3 "1. That by way of present application petitioners seeks indulgence of this Hon'ble Court for issuance of certiorari in nature setting aside the dated 04/05/2022 as letter in memo no. 54/2022-23 b which the OTS dated 22/10/2021 was cancelled a direction was issued to petitioner to deposits the rest balance amount prior to OTS dated 22/10/2021 and further writ/writs, mandamus in nature directing the respondent authorities to act upon one time settlement dated 22.10.2021 which was agreed between the parties for total amount 8,50,000/- (Eight Lacs fifty thousand only) and along with OTS on amount of Rs. 70,000/- (Seventy thousand) deposited and rest balance amount was to be repaid by 24.11.2021 is directed in facts and circumstance of the case for which petitioner are legally entitle for."
In view of the fact that Debts Recovery Tribunal is now functional, learned counsel for the petitioner, under instructions, seeks permission to withdraw the present petition with liberty to take recourse to such other appropriate remedies, as are otherwise available, in accordance with law. Permission granted.
As and when any such request is made by the petitioner before the Tribunal or the respondent-bank, the same shall be considered and decided expeditiously. The petition stands disposed of as withdrawn with the liberty aforesaid.
