JUSTICE ARVIND SRIVASTAVA ORAL ORDER 03-03-2021 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner nos. 2 and 3, since they have been arrested during the pendency of the case. Such permission is accorded.

Accordingly, the application of petitioner nos. 2 and 3 is dismissed as withdrawn.

Heard learned counsel for the petitioner no.1 and the learned A.P.P. for the State.

The petitioner no. 1 apprehends her arrest in connection with Dhoraiya P.S. Case No. 174 of 2019 registered under Section 302/34 of the Indian Penal Code.

Patna High Court CR. MISC. No.30232 of 2020(2) dt.03-03-2021 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner is mother-in-law of the deceased. She is innocent and has falsely been implicated in the present case. Further submission is that the petitioner has got clean antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner no. 1 namely, Sakuna Devi be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Banka in connection with Dhoraiya P.S. Case No.174 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
