2. The petitioner is apprehending arrest in connection with Barari P.S. Case No. 261 of 2020 lodged on 12.10.2020, for the offence punishable under Sections 406 & 420 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against 11 named accused persons including the present petitioner. The petitioners along with other FIR named co-accused persons cheated the informant and his family members in the name of providing ground loans to them.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that petitioner has falsely been implicated in this case
Patna High Court CR. MISC. No.30418 of 2025(2) dt.15-05-2025 2/3 and the allegation levelled against the petitioner is not specific, rather, general and omnibus in nature. Counsel submits that other co-accused persons have been granted bail by the Coordinate Bench of this Court vide orders dated 15.12.2021 & 16.12.2021 passed in Cr. Misc. Nos. 12728 of 2021 & 23076 of 2021 respectively. Counsel further submits that petitioner has no criminal antecedent. Counsel submits that petitioner is ready to deposit a sum of Rs.20,000/- (Rupees Twenty Thousand) in Patna High Court Legal Services Committee, Patna bearing Account No.1413010060836, IFSC Code: PUNB141320, Punjab National Bank, Bar Council Branch, Patna.
5. Learned APP for the State opposes the prayer for bail of the petitioner but submits that if, petitioner is ready to deposit a sum of Rs.20,000/- (Rupees Twenty Thousand) in Patna High Court Legal Services Committee, Patna, then his bail application may be considered.
6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the Bharatiya Nagarik Suraksha
Patna High Court CR. MISC. No.30418 of 2025(2) dt.15-05-2025 3/3 Sanhita, 2023 to the satisfaction of A.C.J.M-5, Katihar in connection with Barari P.S. Case No. 261 of 2020, subject to the conditions as laid down U/s 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
7. It is made clear that the bail bond of the petitioner shall be accepted by the Trial Court only on showing receipt of deposit of Rs. 20,000/- (Rupees Twenty Thousand) in Patna High Court Legal Services Committee, Patna.
