03-03-2022 Heard learned counsel for the parties.

The petitioner seeks bail in Sonepur P.S. Case No. 501 of 2020, registered for the offence under Section 306 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have abetted / instigated the deceased to commit suicide. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case only because of the fact that petitioner was friend of Atisha Kumari (deceased). In fact, one boy committed rape on the deceased, due to which, she was in depression. Only material, which has come against the petitioner, is that at the time of occurrence, this petitioner was seen with the deceased and some hot talk was going on between them. Save & except this, there is nothing against this petitioner

Patna High Court CR. MISC. No.41415 of 2021(4) dt.03-03-2022 2/2 and he is in custody since 01.04.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No. 501 of 2020.
