Petitioner seeks bail in a case registered for the offences punishable under Sections 302,34 of the Indian Penal Code.

Son of this petitioner had taken the husband of the deceased with him and thereafter dead body of the husband of the informant was found from near the house of the petitioner. Murder was committed by commission of assault. Submission is that apparent allegation is against son of the petitioner. Petitioner is aged about 69 years. There is no other material that the petitioner was directly involved in the occurrence of assault to the deceased. Learned counsel for the informant opposed the

Patna High Court CR. MISC. No.31026 of 2019(2) dt.09-05-2019 2/2 prayer for bail.

Petitioner is in custody since 18.12.2018. Investigation of the case is complete.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bagaha (Bhairoganj) Police Station Case No.620 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
