2. The petitioner seeks regular bail in Chandauti P.S. Case No. 326 of 2024, dated 28-08-2024, registered under Sections 103, 109, 3(5) of the Bharatiya Nyaya Sanhita 2023, and Section 27 of the Arms Act.
3.As per prosecution case, while the informant had been going to attend some prayer with his wife on a motorcycle, the co-accused persons fired upon the informant and one shot hit the wife of the informant and the informant also received a gun shot injury. Subsequently, the wife of the informant died. The culprits fled away towards Buniyadganj, leading to the registration of the First Information Report ( for short 'FIR').
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.31221 of 2025(3) dt.20-08-2025 2/3 petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner has not been named in the FIR. The allegations have been specifically attributed against co-accused Jitendra Kumar, who is alleged to have opened fire on the informant and his wife, causing injuries to both, which led to the death of the informant's wife, Amisha Kumari, at the spot. The petitioner's name surfaced in the present case merely on the basis of his self confessional statement. It is further submitted that, during the course of investigation, no cogent material has emerged against the petitioner apart from his self-confessional statement. The petitioner has no connection with the alleged occurrence or with co-accused Jitendra Kumar, who is stated to be the main accused in the case. Lastly, it is submitted that the petitioner is in judicial custody since 01.09.2024 and has no criminal antecedents.
5. Learned Additional Public Prosecutor for the State has opposed the prayer.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount
