The petitioners seek pre-arrest bail in Barun P.S.Case No.113 of 2018 registered for the offences under Sections 147, 149, 341, 323, 308, 379, 504 and 506 of the I.P.C. Accusation is that in the morning of 9.6.2018 Yamuna Singh who happens to be the husband of the informant was engaged in constructing new house demolishing old house in course of which six persons named in the F.I.R. including the petitioners having lathi, danda and rod in their hands reached there and started to abuse and assaulted the husband of the informant and when the son, daughter-in-law of the informant rushed there to save him then both were also assaulted by them. At that time
Patna High Court Cr.Misc. No.54357 of 2018 (2) dt.28-09-2018 2/2 Geeta Devi snatched golden chain from the neck of Rajni Devi, daughter -in-law of the informant.
Submission of the learned counsel for the petitioners is that, in fact, hot talks were exchanged between the parties due to the land dispute and family members of the informant sustained simple injuries. The petitioners have no criminal antecedent. Learned A.P.P. also opposed the prayer for anticipatory bail of the petitioners.
Considering the facts and circumstances of the case, stated above, let the petitioners, in the event of their arrest or surrender before the learned court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad, in Barun P.S.
