JUSTICE SHAILENDRA SINGH ORAL ORDER 20-06-2025 At the outset, learned counsel for the petitioners seeks permission to withdraw the prayer of petitioner No.2, Santosh Singh @ Santosh Kumar Singh, on the ground of his prayer becoming infructuous as he has been arrested.

2. Permission so sought is granted and the prayer of petitioner No.2 stands dismissed as withdrawn.

3. Heard Mr. Shrikesh Kumar Singh, learned counsel for the petitioner No.1 and Mr. Ramesh Chandra, learned APP for the State.

4. The petitioner No.1 apprehends his arrest in connection with Kashim Bazar P.S. Case No. 51/ 2025 dated 19.02.2025 registered for the offence(s) punishable under

Patna High Court CR. MISC. No.36245 of 2025(2) dt.20-06-2025 2/3 Section(s) 115(2), 126(2), 127(2), 351(2), 352 353, 308(4) and 3(5) of the BNS and section 27 of the Arms Act.

The main submissions advanced by learned counsel for the petitioner No.1 are that both the parties are agnates and the main allegations of firing and making demand of extortion are against co-accused Rana Sagar Singh and Santosh Singh and there is no specific allegation against the petitioner and he is simply alleged to have come on the call of co-accused, Rana Sagar Singh at the place of occurrence during the relevant time of the commission of the alleged occurrence and he is not alleged to have played any specific role in the commission of the alleged offence and the petitioner has fair and clean antecedent.

6. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

Considering the aforesaid submissions advanced by the petitioner's counsel and mainly the facts that against the petitioner No.1, there is no specific allegation and he is carrying fair and clean antecedent and specific allegations of firing and making demand of extortion money are against other accused persons, in my opinion, it is a fit case for grant of anticipatory bail to the petitioner No.1. Accordingly, let the petitioner No.1

Patna High Court CR. MISC. No.36245 of 2025(2) dt.20-06-2025 3/3 named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Kasim Bazar P.S. Case No. 51/ 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the BNSS.
