Petitioners seek bail in a case registered for the offences punishable under Sections 188, 290 of the Indian Penal Code and Sections 30(a), 38(i), 56(d) of the Bihar Prohibition and Excise Act, 2016.

About 573 liters of country made liquor was recovered from an auto-rickshaw on which both the petitioners were travelling. One of the petitioners was driver of the said auto-rickshaw. Petitioners have stated on oath that they have got no criminal antecedent.

Considering the entire facts, let the petitioners, above named, be released on bail after completion of investigation

Patna High Court CR. MISC. No.31962 of 2019(2) dt.14-05-2019 2/2 against the petitioners on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kahalgaon Ghogha Police Station Case No. 161 of 2019, with the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (Birendra Kumar, J) Rajan/Banti U T
