08-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking anticipatory bail in connection with Sonepur P.S. Case No. 330 of 2018 registered under Sections 376(i), 120(B) of the Indian Penal Code, pending in the court of learned 1st Additional District & Sessions Judge, Saran at Chapra.

Learned counsel for the petitioner submits that as per allegation the petitioner went to the house of the informant and had pressurized her to marry with the coaccused Md. Arman and when she denied then she was abused and threatened by this petitioner.

Learned Additional Public Prosecutor for the State opposes the prayer for anticipatory bail and submits

Patna High Court Cr.Misc. No.53186 of 2018 (2) dt.08-10-2018 that this petitioner has actively participated in kidnapping of the victim girl. It is he who had taken the victim girl on his motorcycle and had left her with the co-accused Md. Arman. In the given facts and circumstances of this case where there are specific allegation against the petitioner that he had actively participated in the taking away of the victim girl who is admittedly of minor age about 12 years, this court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected.
