JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 This is an application for grant of anticipatory bail in connection with Konch P. S. Case No. 197 of 2016 disclosing offences under Sections 498A/34 of the IPC and Section 3⁄4 of Dowry Prohibition Act.

Case is under Section 498A of IPC. On appearance of the opposite party no.2, the matter was referred to the Patna High Court Mediation and Reconciliation Center. The report of the mediator is available at Flag "Z" that shows the dispute between the parties has been resolved through the process of mediation and both of them has decided to live together. They will respect each other and family members of both the parties will not interfere in their affairs. Further condition is that petitioner shall sent Rs.2000-3000 per month in the account of

Patna High Court CR. MISC. No.29361 of 2019(5) dt.19-12-2019 2/2 opposite party no.2-wife and after Holi, he will take her to Rajasthan and will keep her there.

Learned counsel for both the parties, have admitted the above position.

Having heard both sides, considering the above submissions, this application is allowed. The provisional bail granted to the petitioner, vide order dated 03.05.2019 is confirmed on condition that petitioner has to abide by all the terms and conditions mentioned in the memorandum of agreement, otherwise, his bail bonds shall be cancelled. At the same time, it is also expected that opposite party no.2 shall also abide by all the terms and conditions agreed upon them.

Let a copy of the mediator's report along with memorandum of agreement be sent to the court concerned, for needful.
