The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code. Petitioner is a farmer. Other farmers are also named accused in the FIR with allegation that they produced rent receipt showing area of agriculture land more than it actually was for ensuring purchase of their more paddy other than permissible at the PACS centre.
Submission is that none of the person, who had issued rent receipt in this case is accused. It is not a case of the prosecution that petitioner has forged the said receipt. Moreover, the matter is
Patna High Court Cr.Misc. No.61243 of 2018 (2) dt.05-10-2018 2/2 yet to be decided by cogent evidence that the rent receipts were genuine or not.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal/Successor Court in connection with Arwal Police Station Case No. 105 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
