The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

26.250 liters of foreign liquor has been recovered from a field and petitioner alongwith other co-accused are said to have kept the liquor in the field.

It is submitted on behalf of petitioner that name of the petitioner transpired during course of investigation on the confessional statement of co-accused. Nothing has been recovered from the possession of the petitioner. Petitioner has got clean antecedent.

Considering the nature of allegation and clean
