The petitioners apprehend their arrest in a case registered for the offences punishable under Section 341, 323, 379, 354-B and 385/34 of the Indian Penal Code.
Patna High Court CR. MISC. No.29246 of 2019(2) dt.07-05-2019 2/3 Petitioners along with one another accused person are said to have descended at the land of the informant and tried to encroach it and on protest made by him they assaulted the informant, his wife and the cousin brother and also disrobed his wife. They also demanded rupees five lakhs in lieu of release of his land. Learned counsel for the petitioners submitted that no such occurrence as alleged ever took place. The petitioners are quite innocent. They have been falsely implicated in this case merely because the title suit between the petitioners and the informant was pending which was dismissed for default and for restoration of the aforesaid title suit informant has filed a restoration application. The allegation levelled against the petitioners are not specific rather general and omnibus in nature. Petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each
