Petitioner apprehends arrest in connection with Bodh Gaya P.S. Case No. 442 of 2018 registered for the offence punishable under sections 30(a)/30(d) of the Bihar Prohibition and Excise Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely on basis of suspicion. As a matter of fact, nothing has been recovered from the conscious possession of this petitioner. The alleged recovery is from the joint house. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the
Patna High Court Cr.Misc. No.54121 of 2018(2) dt.12-09-2018 2/2 petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gaya in connection with Bodh Gaya P.S. Case No. 442 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
