JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-10-2018 As prayed for, learned counsel for the petitioners is permitted to make necessary correction in the cause title of this application with regard to the name of the petitioner no.3. Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Bacchwara P.S. Case No.61 of 2018 registered under Sections 366 and 366A/34 of the Indian Penal Code.

The accusation of the informant is that a boy in the name of Rahul had come in the house of her neighbour Divesh Yadav in marriage function. In that course, Rahul used to talk with the daughter of the informant on mobile phone regarding which protest was made. In the evening of 27.03.2018, under conspiracy, Divesh

Patna High Court Cr.Misc. No.54737 of 2018(2) dt.10-10-2018 2/2 Yadav (petitioner no.3), his wife Pinki Devi (petitioner no.2) and Bulo Devi (petitioner no.1) got managed to entice away the daughter of the informant with Rahul Kumar.

Learned counsel for the petitioners submits that it would appear from the F.I.R. that Rahul Kumar had come in the house of the petitioners, who is said to have enticed away the daughter of the informant. Further submission is that, in her statement recorded under Section 164 of the Code of Criminal Procedure on 12.04.2018, the daughter of the informant has stated that she left the house due to misbehaviour of her mother (informant) and at the time of recording her statement under Section 164 of the Code of Criminal Procedure, the daughter of the informant disclosed her age as 19 years. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Bacchwara P.S. Case No.61 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
